Mark S. Yagerman

“Mark S. Yagerman received his law degree from Cardozo
School of Law after graduating magna cum laude from Brooklyn College. Mark joined Smith Mazure Director Wilkins
Young & Yagerman, P.C., in 1985 and is currently a Member of the firm’s Executive Committee. Mark is regarded by
the firm as one of its top trial attorneys, having tried approximately 130 cases to jury verdict. Prior to joining
Smith Mazure, Mark worked with the New York City Transit Authority as Assistant General Counsel (1983-1985), and prior to
that, was a Trial Attorney for the New York City Transit Authority's Torts Department (1980-1985). Mark has significant
experience in litigating cases in multiple areas of insurance defense including Alternative Dispute Resolution, Appellate
Practice, Claims Management, Construction Accidents, Excess Risk Claims, General Liability, Insurance Coverage Litigation,
Lead Paint, Mold and Toxic Tort Litigation, Municipal Litigation, Premise and Security Liability, Products Liability and Transportation-related
Accidents. Many of the cases involved complex issues involving defense of products, power tools, constitutional libel,
subway and bus accidents, catastrophic injury, construction defect, NY Labor Law, and breach of security claims. Moreover,
Mark has argued cases in New York's Court of Appeals with many of his cases setting precedent in New York. Mark
is a published author and lecturer on industry-relevant legal issues. He has lectured at Brooklyn College and has conducted
CLE courses at The New York State Bar Association, Cardozo School of Law and the New York State Trial Lawyers Association.
He has written several articles such as “Indemnification and Article 16: In for a Penny or Pound?” New
York Law Journal, (May 4, 2006); “Got Mold”, New York Law Journal, P.1, (June 24, 2002); Objections:

reprinted in Magistrates Report, June,1978. Mark is admitted to practice in the State of New York, in Federal Court, Eastern/Southern
Districts, Connecticut Federal Courts and the United States Supreme Court. Moreover, Mark's extensive experience in personal
injury litigation, municipal liability, products liability and the insurance industry have qualified him for an AV rating with
